1. General

This Privacy Policy applies to the online platforms Shopndeli.co online platform is operated by Shopndeli Limited, a company registered in England and Wales, Company number 13211136. Unless otherwise specified under specific sections, this Privacy Policy applies to all of our Platforms. More details about how to get in contact with us can be found at the end of this Privacy Policy under No. 7.

We take your privacy extremely seriously. All data will be collected, stored and used by us in accordance with the European Union General Data Protection Regulation No. 2016/679 (“GDPR”), other statutory regulations.

The services offered by us via the Website and/or App (jointly "Platform") can function only if we collect, store, transfer, delete and/or otherwise use ("collect and use") specific data relating to you. Personal data means all information relating to an identified or identifiable natural person such as your name, date of birth, address or email address.

This Privacy Policy describes which of your data we collect and for what purposes we collect and use it when you use the services offered by us on the Platform. This Privacy Policy also contains important information on the protection of your data, especially the statutory rights you have in connection with it.

Certain services on our Platform are offered by third-party suppliers. When you use these services, the data protection regulations of the third-party suppliers will then apply in addition to this data protection statement. Prior to your use of such services, the third-party suppliers may require you to provide permission under data protection law.

Under applicable data protection laws, Shopndeli is obligated to inform you about data processing and Shopndeli fulfills this obligation within this Privacy Policy. This Privacy Policy and any parts of it are not meant as contractual clauses and do not become part of the general terms and conditions ("GTC") as a contract that is concluded with registered users. Under applicable data protection laws, Shopndeli can process data that is necessary for the performance of a contract with you or necessary for taking steps at the request of you prior to entering into a contract (Art. 6 (1) (b) GDPR). References to the GTC should at all times be understood as information on data processing (Art. 13 and 14 GDPR) and never as clauses that become part of the GTC. By using the Platform and our services, you enter into a legally binding contract between you and Shopndeli conditions of which are described in the GTC.

2. Why and how do we collect and use your data?

2.1. To enable you to use the Platform, allow us to provide our services and perform our GTC

We collect and use your personal data to allow you to use our Platform, to provide our services and to perform a contract (GTC) with you and especially to undertake commercial transactions via the Platform, to use the electronic payment system or to leave reviews and communicate with other members. To use these services, you need a Shopndeli account. For this purpose, you must register as a member on the Website or App.

Most of your personal data are required to perform a contract (GTC) with you. In case you do not provide us with this personal data, we will not be able to conclude and execute a contract (GTC) with you. Part of your data is required to fulfill our legal obligations when you are a member of our Platform. In case you do not provide us with this personal data, we will not be able to comply with legal requirements and provide our services.

This data is also used for the improvement of the Platform in order to make it a better experience for our members (see 2.2.12).

Shopndeli collects your personal data to allow you to use our Platform, to provide our services and to perform a contract (GTC) with you and keeps it for as long as we keep your Shopndeli account - for 3 months from the date of deletion of your Shopndeli account or for 5 years and 3 months of inactivity on your account.

2.1.1. To enable registration on the Platform

When you register as a member on the Platform, you must provide the following data in order to carry out the registration procedure and access your Shopndeli account:

  • User name (necessary when you register without a Facebook or Google account);
  • Email address;
  • Confirmation that you are aged over 18;
  • your full name;
  • Password (necessary when you register without a Facebook or Google account).

Legal basis for the collection and use of data is the performance of a contract (GTC) to which you are a party or in order to take steps at your request prior to entering into a contract (GTC) (Art. 6 (1) (b) of the GDPR).

We also determine your location at the time of registration to show on your profile. You can at any time choose to change your location (country, city or region) and make your city or region not visible to other members under "My settings" in your Shopndeli account.

Personal data collected and used for this purpose are kept for as long as we keep your Shopndeli account – for 3 months from the date of deletion of your Shopndeli account or for 5 years and 3 months of inactivity on your account.

2.1.2. To authenticate you via Google and Facebook

If you register using your Google Ireland Ltd. (Ireland), Google LLC (USA) (“Google”) or Facebook Ireland Ltd. (Ireland), Facebook, Inc. (USA) (“Facebook”) account or later on decide to connect your Google and/or Facebook account to your Shopndeli account, you will be transferred from our Website or App to the website of Facebook or Google and asked to enter the log-in details for your Facebook or Google account.

If you enter your Google log-in details, Shopndeli will receive from Google the following data from your Google account (you may choose not to provide some data):

  • Profile photo;
  • First name and surname;
  • Google account ID;
  • Email address;

If you enter your Facebook log-in details, Shopndeli will receive from Facebook the following data from your Facebook account (you may choose not to provide your email address and/or date of birth):

  • Profile photo;
  • First name and surname;
  • Gender;
  • Email address;
  • Date of birth.

The data we obtain from Facebook or Google will be used to set up your Shopndeli account. This means that we will use the member name of your Facebook or Google account as the member name for your Shopndeli account so that it will be visible to other visitors to the Website and users of the App. Other data obtained from Facebook or Google will not be visible to anyone on the Platform.

You can at any time undo the link with your Facebook or Google account. This can be done under "My settings" in your Shopndeli account. If, however, when you initially registered, you did so without linking to your Facebook or Google account, you can create this link later.

Collection and use of data is based on your consent (Art. 6 (1) (a) of the GDPR).

Personal data collected and used for this purpose are kept for as long as we keep your Shopndeli account – for 3 months from the date of deletion of your Shopndeli account or for 5 years and 3 months of inactivity on your account.

2.1.3. To enable you to set up your profile information

If you decide to add profile details to the account you create on the Platform, we collect and use the following data when you choose to provide it:

  • Full name;
  • Gender;
  • Date of birth;
  • Profile photo;
  • Whether you have enabled the Holiday Mode;
  • Your favorite items;
  • Information that you choose to provide in the “About You” field.

Your profile photo, information on whether you have enabled the Holiday Mode and the information you provide in the "About You" field are visible to other visitors of the Platform, but the remainder of the data entered by you is not visible.

Legal basis for such collection and use is your consent (Art. 6 (1) (a) of the GDPR).

Personal data collected and used for this purpose are kept for as long as we keep your Shopndeli account – for 3 months from the date of deletion of your Shopndeli account or for 5 years and 3 months of inactivity on your account.

2.1.4. To show other members relevant information regarding your activity on the Platform

When you are a registered member on the Platform, we collect, use and make public on the Platform the following information for the purpose of providing other members with the relevant information:

  • Last login date;
  • Verification fact;
  • Number and member names of followers;
  • Number and member names of members followed;
  • Likes.

Legal basis for such collection and use is our legitimate interest to ensure that our members would access important information about each other (Art. 6 (1) (f) of the GDPR).

Personal data collected and used for this purpose are kept for as long as we keep your Shopndeli account – for 3 months from the date of deletion of your Shopndeli account or for 5 years and 3 months of inactivity on your account.

2.1.5. To enable you to list your items

If you list items on the Platform, we will collect and use the following data for the purpose of creating and publishing listings on the Platform (list of required information differs depending on the chosen item category):

  • Item title;
  • Item description;
  • Item category;
  • Item brand;
  • Item condition;
  • Item size;
  • Item color;
  • Item material;
  • Item photos;
  • Information whether the item is unisex;
  • Price;
  • Discount;
  • Information whether an item is marked as reserved;

Legal basis for such collection and use is your consent (Art. 6 (1) (a) of the GDPR). Personal data collected and used for this purpose are kept for 18 months and 7 days of inactivity. Photos are kept for 3 months after the item is deleted.

2.1.6. To enable notifications for you

When you are a registered member on the Platform, we will provide you with notifications regarding your new followers, your favorite items, your activity on the forum and other important messages.

Personal data collected and used for this purpose are kept for as long as we keep your Shopndeli account – for 3 months from the date of deletion of your Shopndeli account or for 5 years and 3 months of inactivity on your account.

2.1.7. To enable you to communicate with other members

If you communicate with other members on the Platform, we collect and use the following data:

  • Name of the member you are communicating with;
  • Messages;
  • Date and time of messages;
  • Shared photos;
  • Your device;
  • Information whether another member has seen your message;
  • Other data submitted in messages.

Personal data collected and used for this purpose are kept for as long as we keep your Shopndeli account – for 3 months from the date of deletion of your Shopndeli account or for 5 years and 3 months of inactivity on your account.

Shopndeli Terms & Conditions of use

GENERAL CONDITIONS OF USE - new version applicable from 1 July, 2021

The platform Shopndeli (hereinafter referred to as the "Site") is managed and hosted by the company Shopndeli LIMITED (hereinafter referred to as "Shopndeli"), located at - 25 Padelford Lane, Stanmore, England, HA7 4WU

Before signing-up on the Site, every User must read these General Conditions of Use (hereinafter referred to as the "Terms and Conditions"), the Privacy policy (as indicated in the definitions), as well as the other compulsory provisions of the Site whether or not they are recalled in these Terms and Conditions (including the Catalogue Rules, Forum Rules and the Price List), accept them and undertake to comply with them.

1. PURPOSE

1.1 These Terms and Conditions define the relationship between Shopndeli and the Users or Visitors as well as the relationship between Users, Visitors or Users and Visitors. By using or accessing the site you agree to be legally bound by these Terms.

1.2 You may contact Shopndeli by completing the form

1.3 The Site gives the User the opportunity to become involved with the exchange and/or sale and/or purchase of Items, and to use the other Additional Services offered by the Site.

1.4 The Services are not intended for minors under the age of 18. For minors, a parent or guardian (adult) must register for the use of the Services and supervise the use of the Services by the minor. Professional Sellers are not authorised to use the Services.

1.5 When registering on the Site, the User must state his/her user name (pseudonym), email address and password (expressly or via a Facebook or Google profile), to enable the Site to identify the User each time he/she accesses the Site. Even if the User provided his/her surname and first name when registering on the Site, the other Users will see only the user name (pseudonym) of the User, which may be different from his/her surname and first name. Shopndeli may request a User to verify his/her Account for security purposes. This can for example take place by verifying the User's Facebook or Google account, the User's telephone number, the User's credit card or debit card, pin-code based or any other confirmations that Shopndeli may introduce in its sole discretion. All data collected as a result of such confirmation will be processed following our Privacy Policy.

1.6 Shopndeli may, at its full discretion, amend the Terms and Conditions in particular in order to: a) adapt the Terms and Conditions to legislative or regulatory provisions in force or being adopted; b) adapt the Terms and Conditions to any decision handed down by a jurisdiction, a consumer agency or by any other competent authority, which affects the content of the Site or the Services offered by it; c) reflect changes and developments in how Shopndeli operates the business; d) reflect changes in market conditions or standard industry practice; e) amend the Price List, in particular the prices indicated in it.

1.7 If Shopndeli makes any of the changes identified in 1.6, Shopndeli will inform Users about the amended Terms and Conditions:

1. fifteen (15) days before the day on which the amendments take effect; or
2. four (4) weeks before the day on which the amendments takes effect in case of substantial amendments (e.g. amendments that increase obligations of Users, impact on main functionalities of the Site).

1.8 Unless Users terminate the relationship with Shopndeli before the day on which the amendments take effect ), the amended Terms are considered accepted by the User. If the user objects timely, he/she may choose to terminate his/her relationship with Shopndeli and close his/her Shopndeli account, as per section 15.3. Any amendment to the Terms and Conditions published on the Site will apply immediately to Visitors and to those Users who complete the online registration process following the publication of any such amendments on the Site.

2 DEFINITIONS

Additional Service(s) – means the additional payable services provided by Shopndeli and offered on the Site (as shown in the Price List), such as Bumps and Buyer Protection, which are not main services and which may be subject to separate conditions of use.

Buyer – means any User who buys or wishes to buy one or more Item(s) on the Site; Buyer Protection – means the Additional Service offered by Shopndeli where the Buyer will benefit from additional protections only if they use the Integrated Payment and Shipping Service, as detailed in section 6.5 below of these Terms.

Integrated Payment and Shipping Service – means the Service consisting of the Integrated Payment Service and the Integrated Shipping Service, which is optional for the User, facilitating and securing the payment and delivery of an Item when the Transaction consists of a sales contract.

Integrated Payment Service – means the online payment Service for Items accessible by the Buyer from the Site, the payment services being undertaken Shopndeli’s partner Stripe.

Integrated Shipping Service – means the shipping and delivery Service paid for by the Buyer, enabling the Seller to deliver the Item to the Buyer as part of a sales contract, with the shipping, transport and delivery services being undertaken by one of the partners of Shopndeli as detailed in section 7;

Items – means the goods/items whose sale is not forbidden by national applicable law or prohibited by the Catalogue Rules and that are listed by the User in the Site’s corresponding Catalogue, in order to sell, exchange or donate them;

Main Services – means the option offered by Shopndeli to Users and, when applicable, Visitors, to list the Items in the relevant Catalogue, to examine the Items, to directly participate in the exchange or purchase-sale or other Transactions, to use the Integrated Payment and Shipping Services and to communicate in private and/or in public;

News – means content shared by Shopndeli on the Site relating in particular to short and long-term offers, competitions or new Services published on the Site;

Private Messages – means communication by an exchange of private messages between Users via the Site’s messaging system, which can only be accessed by the Users concerned;

Privacy Policy – means the document that defines the manner in which Shopndeli collects, uses, stores and transfers personal data and other important information of a Visitor or a User;

Receipt Confirmation – means the confirmation that the Buyer or the User has received the Item;

Seller – means any User who lists one or more Item(s) in the relevant Catalogue of the Site;

Services – means all the services offered by the Site, including the Main Services and the Additional Services; Site – means the Shopndeli website, as well as the mobile applications of the Shopndeli platform downloaded on smartphones or tablets;

Social networks Accounts – means Shopndeli’s accounts on Facebook, Google+, Twitter, Instagram, Pinterest, YouTube and other social networks where information is provided about the Site and the Services it offers, sharing the contents published by Users;

Terms – these Terms and Conditions and all policies and additional terms posted on and in Shopndeli’s Site, set out the terms on which Shopndeli offers Users and Visitors access to and use of Shopndeli’s Services.

Transaction – means all the transactions, which transfer the ownership of and/or the right to use an Item from one User to another, including but not limited to, the sales contract concluded directly between the Buyer and the Seller, or the exchange or any other transaction carried out between Users;

User – means any individual who has created an account on the Site and has accepted the Shopndeli Terms & Conditions. For the sake of clarity a User in these Shopndeli’S Terms and Conditions, means an individual who is a consumer and acts as an individual to satisfy his/her personal requirements that are not associated with a professional activity;

User account or Account – means the User’s account created upon registration on the Site; the created account contains personal information;

Visitor – means any individual not signed-up on the Site likely to use the Site without being registered, in accordance with the Terms and Conditions.

We’ll issue a refund if your item is never shipped, arrives damaged, or is not as described. You have 2 days to submit a claim. Unless agreed otherwise, the buyer covers return fees.
